All users of the website www.reteleelectrice.ro (hereinafter referred to as the “SITE”) undertake to observe its general conditions of use. The SITE implicitly refers to all services/applications/products/information and generally, to its entire contents.

The phrase “RETELE ELECTRICE” refers to the following electricity distribution companies:

●      Retele Electrice Muntenia S.A., a Romanian legal entity with registered office in Bucharest, 30 Mircea Vodă Boulevard, district 3, registered with the Trade Register attached to Bucharest Tribunal under no. J40/1859/2002, unique tax identification number 14507322;

●      Retele Electrice Banat S.A., a Romanian legal entity with registered office in Bucharest, District 3, 30 Mircea Voda Blvd., 3rd floor, room 3.33, registered with the Trade Register attached to Bucharest Tribunal under no. J40/3793/21.02.2024, unique tax identification number 14490379;

●      Retele Electrice Dobrogea S.A., a Romanian legal entity with registered office in in Bucharest, District 3, 30 Mircea Voda Blvd., 3rd floor, room 3.21, registered with the Trade Register attached to Bucharest Tribunal under no. J40/3794/21.02.2024, unique tax identification number 14500308.

Art. 1. User’s Obligations

1.1.  The User agrees to use the SITE only for legal purposes and in good faith. To this end, the User shall be strictly forbidden:

• to send or create harassment, discriminatory, slanderous, fraudulent or threatening messages, including offensive messages regarding the race, sex, age, sexual orientation, religion, political beliefs, national origin, disability, ethnic origin, sexual identity or any other feature protected by law and which may be deemed as discriminatory;
• to send, access or store any offensive, obscene materials or communications as well as any other information which violates the applicable legal provisions;
• to distribute any confidential information in a unauthorized manner;
• to cause or favour the information security breaches and/or interrupt the communication in the communications network belonging to RETELE ELECTRICE;
• to carry out any activities which could jeopardise the security of the SITE (cyberattacks);
• to infringe any right protected by the copyrights, trade secret, patent and/or other intellectual property rights, as well as any other similar laws and regulations due to the registration, copying, sharing, lending and/or reproduction of the SITE, etc.

1.2. The user undertakes not to carry out any actions which could prejudice RETELE ELECTRICE.

1.3. The payment of all additional costs in relation to the use of services made available to the Users through the agency of the SITE, including those which the telephony or internet service provider could request, shall fall within the responsibility of the User.

1.4. The User undertakes to immediately notify RETELE ELECTRICE about (i) the non-observance of these general conditions, (ii) any infringements of the intellectual property rights related to the contents of the SITE, as well as about (iii) the use of 2/4 for commercial purposes of the materials available on it, in the event where the User has knowledge/information regarding these situations. The complaints may be sent by using the contact data in the section of the SITE entitled “Useful Contacts”.

1.5. The incapable persons and/or with limited powers may use the SITE only for information purposes, and not for the registration as User. This rule shall also apply in the case of personal data processing operations. By accepting these General Conditions of use of the SITE, the User states in his own responsibility that he has full powers.

Art. 2. Limitation of RETELE ELECTRICE liability

2.1. The use of the SITE shall be made on the User’s own responsibility. The SITE is made available to the User according to the principle “as it is”, “as such” or “as available". RETELE ELECTRICE shall not be responsible for any direct or indirect loss suffered by the User as a result of the use of the SITE.

2.2. The user is the only person responsible for the possible destructions caused to the access terminal (for example, but not limited to: laptop, tablet, smart phone, computer) on which the SITE is accessed, as well as for any other data losses which may result following the use of the SITE.

2.3. The User agrees to exempt from liability and not to bring any proceedings against RETELE ELECTRICE both in relation to any claim lodged by a third party, resulting from the use of the SITE and/or of the communications network of RETELE ELECTRICE and of the internet by the User, and also in relation to any loss (direct, indirect or of a different nature), costs, actions, proceedings, claims, costs (including the legal fees) and/or other liabilities, suffered in any way or directly caused by RETELE ELECTRICE as a result of the violation or disregard of these conditions by the User.

2.4. The obligations of RETELE ELECTRICE regarding the SITE shall be exclusively regulated by the agreements according to which the contents of this SITE is delivered and/or supplied. No material and no information on this SITE must be interpreted for the purpose of altering the trade agreements to which RETELE ELECTRICE is a party.

2.5. RETELE ELECTRICE reserves the right to amend at any time, and without any prior notice, the contents of the SITE, (including, but not limited to: materials, services, prices, offers etc.), the User stating that he expressly accepts this provision. The amendments made in this manner shall be deemed as tacitly accepted by the User if he continues to use the service after their display on the SITE.

2.6. RETELE ELECTRICE does not guarantee the accuracy of the contents of the SITE. It is possible that this SITE contain references to products, programs and/or services which are out of date. The additional information regarding the products, the programs and the services available at this time may be obtained using the contact data in the section of the SITE entitled “Useful Contacts”.

2.7. RETELE ELECTRICE shall not be held liable for any direct or indirect damages suffered as a result of accessing or using the available information on the SITE which is proven to be inaccurate.

Art. 3. Intellectual property rights

3.1. RETELE ELECTRICE owns all intellectual property rights related to the entire contents of the SITE, including, but not limited to: the way of description of the services, images, competitions and extractions, music, digital graphics etc. By the continued use of this SITE, the User expressly states that he has taken note of the fact that all the stylised representations, all logos and associated symbols and combinations thereof with any word or graphic symbol, used on this SITE, are registered trademarks of RETELE ELECTRICE.

3.2. RETELE ELECTRICE allows the visualization and download of the materials on this SITE exclusively for personal, non-commercial use and only subject to maintaining in these materials all the announcements related to copyrights and/or other announcements regarding the intellectual property rights present in the materials on the SITE.

3.3. They shall be strictly forbidden, for example, but not limited to the amendment, reproduction, display, carrying out or public distribution, lease, lending, use, selling of the materials on this SITE, as well as the creation of certain materials derived using the contents and/or the form of the SITE. The use of these materials shall be strictly forbidden on another site and/or on any other networked computerized medium.

3.4. The non-observance of any of these general conditions shall automatically result in the cancellation of the right to use the SITE, as well as in the destruction/immediate return by the User of all downloaded and/or printed materials and the payment of damages.

Art. 4. Security

4.1. The User understands that the services are available through Internet – a network which is not under the direct or indirect control of RETELE ELECTRICE. Nevertheless, RETELE ELECTRICE makes all efforts necessary for maintaining the information security and takes appropriate technical and organizational measures to ensure the data security and the availability of the SITE.

4.2. In addition to the above-mentioned, RETELE ELECTRICE recommends to the User to permanently verify the security policies of the browser used, as well as the terminal used to access the SITE, so that it contains an installed and updated software against any kind of viruses or external attacks of the cracking or hacking type.

4.3. The user undertakes to deliver valid data and information and communicate any variations which occur, in due time.

4.4. The User understands that the access to certain functions of the SITE may be restricted and accessible only for certain categories of Users.

4.5. The users affecting the security of the RETELE ELECTRICE systems or of the networks or endangering their integrity shall bear the (criminal or civil) consequences established by the applicable legal rules into force.

Art. 5. Connection to other networks/sites/links

5.1. There is the possibility for the SITE to be used by the User to find out various information displayed by RETELE ELECTRICE, to make the connection to other networks or websites worldwide, and the User undertakes to observe the use policies valid in these networks or sites. The user accepts the state of affairs that RETELE ELECTRICE does not control such sites, it is not responsible and does not assume any obligation as regards the contents of other sites, links etc. At the same time, RETELE ELECTRICE recommends to the User to read the confidentiality policies of all and any external sites carefully.

5.2. Any inclusion of links to other sites or networks is only made to help the User and does not involve the support/confirmation of RETELE ELECTRICE regarding the available material on or through those sites/networks and any association with their controllers. The user exclusively accesses these sites/links at his own risk.

5.3. RETELE ELECTRICE does not guarantee that the services or materials delivered by third party sources are acceptable and available in any region of Romania. If the User accesses other contents or services on the sites of other controllers, RETELE ELECTRICE shall not be responsible for the non-observance by the User of the local laws and/or other legal acts into force in those states.

Art. 6. Personal Data Processing

6.1. RETELE ELECTRICE ensures the User in relation to keeping the confidentiality of his personal data and the observance of his right to protection of privacy, as regards the processing of his own personal data. This obligation shall not subsist if the respective information was disclosed by the User to other persons or if that information came into the possession of other persons in a fraudulent way or in the case where RETELE ELECTRICE is obliged to disclose it due to the provisions set forth in the applicable legal acts, or upon control and request of the relevant bodies.

6.2. The refusal of the User regarding the processing of personal data shall be taken as the impossibility of delivering certain electronic communications services, as well as making available the services of the SITE and shall exempt RETELE ELECTRICE from any liability to this end. If the User does not express his consent as regards the processing of personal data subject to this article, the User may refer to the contact data and mailing addresses mentioned in the section “Contact”.

6.3. According to the requirements of the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“Regulation”), and of Law no. 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector, the above mentioned data controllers, as well as their processors process and manage the personal data collected from natural persons for the purpose of management of the User’s accounts, settlement of the Users' questions, prevention or detection of offences or frauds, improvement of the SITE and increase of the Users' satisfaction.

6.4 The legal bases of the activities of personal data processing carried out by RETELE ELECTRICE are:

1. the performance of a contract to which the data subject is a party or to take certain actions at the request of the data subject before the conclusion of a contract.

2. the User’s express consent

3. the legitimate interest of RETELE ELECTRICE consisting of: (i) taking actions for the prevention of frauds/offence or (ii) continual improvement of the services provided by RETELE ELECTRICE

6.5 RETELE ELECTRICE will process the following personal data of Users:

1. Index information, consumption history, POD, address of place of consumption, mailing address;

2. Customer identification information - information that allows the user to be identified and contacted, such as: first and last name, home address, CNP, bank account, land register / cadastral number, postal code, e-mail address, telephone number, password.

6.6 The processing of personal data is directly carried out by the above mentioned data operators, depending on the geographical area where the consumption place is located, as well as by processors, according to the provisions of the Regulation, through manual/automated means, in compliance with the safety requirements for the processing of personal data. The personal data are disclosed only to authorized persons, under the conditions established by appropriate technical and organizational procedures to keep confidential the personal data, to protect them against accidental or illegal destruction, loss, disclose or unauthorized access, according to law.

6.7. The User is required to maintain all personal data supplied on this SITE updated. RETELE ELECTRICE reserves the right, at successive periods of time, to recommend you or even to expressly request you either the reconfirmation of the personal data supplied on this SITE, or the renewal of the consent regarding the processing of personal data.

6.8. The processing of personal data is carried out in compliance with the section Personal data which shall be an integral part of these general conditions.

Art. 7. Force Majeure

RETELE ELECTRICE does not assume any responsibility for the impossibility of complying with the obligations provided for in these conditions, as a result of any other reason beyond its control, including, but not limited to any acts of God, adverse weather conditions, action or inaction of the government, of other networks or of other competent authorities for which RETELE ELECTRICE is not responsible.

Art. 8. Applicable laws

8.1. These general conditions of use of the SITE represent, in whole, an agreement entered into between yourselves and RETELE ELECTRICE having as subject-matter the use of the SITE.

8.2. By accessing this SITE, the User accepts that this contract and any dispute related to it are governed and interpreted in compliance with the Romanian laws, and the User admits to submit to the exclusive jurisdiction of the courts within the Romanian territory. This website may be accessed wherever within the Romanian territory and outside this territory (in other states), to the extent permitted by the technical conditions. RETELE ELECTRICE does not provide any guarantee according to which the SITE is subject to laws (including the intellectual property laws) of other countries outside Romania. If the User accesses this SITE outside Romania, he makes it at his own risk, being the only person responsible for the observance of the laws applicable on the territory where he resides.

Art. 9. About the cookies used on the SITE

9.1. We hereby inform you that the SITE uses cookies.

9.2. Any User may set up the browser to reject the files of the cookies type. The deactivation and the refusal to receive cookies may render certain sections/pages impracticable or difficult to access and use.

9.3. The storage of cookies on the User’s devices provides us an easy and appropriate manner of customizing or improving the User’s experience on the SITE and of making the following visit more pleasant. RETELE ELECTRICE does not use any cookies to collect personal data (for instance, but not limited to: last name(s), first name(s), identification data etc.), nevertheless, due to the IT technologies used, certain connections may be made between the information contained in a cookie and your personal data collected by other means (for instance, but not limited to: registration forms).
