Compensations – general information

If, for objective reasons, we are unable to observe the performance indicators set in ANRE’s Performance Standard for electricity distribution operators, you are entitled to compensation from us.

Do not mistake compensations for indemnifications, which are also mentioned below and about which you can obtain detailed information here.

If, for objective reasons, we register delays or we are unable to observe the indicators set under the performance standard, we will grant you compensations. Granting a compensation of this type does not preclude the user’s to receive, upon request, indemnification for the material damage caused because of our fault.

Where, for the same situation, you are entitled to receive both compensation and indemnification, you will only receive one of them, respectively the one bearing the highest value. If the amount of indemnification you claim is greater than the amount of compensation already received, you will receive the difference between the two amounts, without having to return the amount of the compensation.

Granting compensation

As of January 1st 2019, the compensation for the failure to observe the performance indicators regarding the continuity of the electricity distribution service is automatically, granted, irrespective of whether your consumption and/or production place is connected to the low, medium or high voltage electricity distribution network – there is no need for you to submit an application in this respect.

The distribution operator will pay these compensations directly to you, in case the distribution contract was concluded with you, or through the supplier, in case the distribution contract was concluded with the latter.

Depending on your choice as to the conclusion of the electricity distribution contract, the compensations are granted:

  • through the supplier, within 30 calendar days as of the submission of the notification, in the manner agreed upon in the distribution service contract. The date on which the notification is sent to the supplier is of 15 calendar days as of the performance indicator non-compliance date;
  • directly, in case the distribution contract was concluded directly with you.

In case the distribution contract was concluded with an electricity supplier, we will inform the latter on your right to receive the compensation, as well as on its amount, within no more than 15 calendar days as of the non-compliance date. The supplier will pay this amount to you.

In case you entered the distribution contract directly with us (the distribution operator), we will send a notification on your right to receive compensation, also indicating the amount thereof, via a letter attached to the first invoice issued after the date of non-compliance with the performance indicator (deviation).
